Terms of Service

1. Service overview

BoostByte Forms is a free survey-building and response-collection platform operated by F.I.T.S. (Forged Innovative Technology Solutions) and designed by BoostByte One. The service is provided free of charge subject to fair-use limits. There are no paid tiers or paywalls.

From time to time we may run a private or public beta. During beta, registration may be capped, features may change without notice, and we welcome feedback via the Contact or Support pages. Beta participation does not guarantee future availability of any feature or limit.

2. Account eligibility

• You must be at least 13 years of age to create an account.
• You must provide accurate information during registration and keep it up to date.
• One person may not create multiple accounts to circumvent fair-use limits.
• You are responsible for all activity that occurs under your account.

3. Acceptable use

You agree not to use BoostByte Forms to:

• Collect data from minors without verified parental consent.
• Conduct spam, phishing, or deceptive surveys.
• Distribute malware, harmful scripts, or any form of malicious content.
• Attempt to access another user's data, accounts, or organisation workspaces without authorisation.
• Reverse-engineer, scrape, or probe the platform infrastructure.
• Violate any applicable local, national, or international law.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

4. Fair-use limits

To keep the platform stable and free for everyone, fair-use limits apply:

• Up to 5 organisations created per account.
• Membership in up to 10 organisations (created + joined by invitation).
• Up to 20 new surveys per organisation per calendar month (shared by all members of that organisation).
• Daily limits on AI survey drafts, AI response summaries, and help-assistant messages per account.
• Rate limits on outbound notification emails per user and per organisation.
• During beta, a cap on total platform registrations may apply.

These limits may be adjusted over time and are configurable by administrators.

5. Intellectual property

You retain full ownership of the survey content, questions, and response data you create. By using the platform you grant F.I.T.S. a limited, non-exclusive, royalty-free licence to store, display, and process that content solely to provide the service to you.

The BoostByte Forms platform, design, code, brand, and logo are the intellectual property of F.I.T.S. and BoostByte One. You may not copy, rebrand, or redistribute them.

6. Donations

Monetary contributions made through the Support page are voluntary donations and do not entitle the donor to any additional features, service guarantees, or refunds. All payments are processed by WiPay Financial. We do not store payment card details.

7. Disclaimers and limitation of liability

BoostByte Forms is provided "as is" without any warranties, express or implied. We do not guarantee uninterrupted access, zero data loss, or specific uptime. To the fullest extent permitted by law, F.I.T.S. and BoostByte One shall not be liable for indirect, incidental, or consequential damages arising from your use of the platform.

8. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via a site notice or email. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.

9. Governing law

These terms are governed by the laws of Trinidad and Tobago. Any disputes shall be subject to the jurisdiction of the courts of Trinidad and Tobago.

10. Account deletion

You may delete your account at any time from Account Settings. By confirming deletion you acknowledge and agree to the following:

• Your login access is removed immediately. You will be signed out and cannot sign in again unless an administrator restores your account.
• Your account is soft-deleted right away. This is not the same as an instant permanent wipe — your profile record may remain in our systems for a limited period, including encrypted backups, before it is permanently removed or anonymised.
• Surveys, responses, branding assets, and other content in organisation workspaces you contributed to may remain available to other active members of those workspaces. Deleting your account does not delete shared organisation data.
• Organisations you created may continue to exist if other members remain, or may become inaccessible until reviewed by our team if you were the only member.
• Donation and payment records linked to your account are retained for at least 7 years to meet financial and tax record-keeping requirements. After deletion, these records may be kept without your login profile but with the donor details submitted at payment time.
• Security, audit, and anti-abuse logs may be retained for a limited period where required for fraud prevention, dispute resolution, or legal compliance.
• Account deletion is voluntary and cannot be undone by you once confirmed. Contact support promptly if deletion was made in error.
